Practice Profile
Hugh Flanagan has a practice encompassing all aspects of planning, major infrastructure, and compulsory purchase law. He specialises particularly in energy (including renewables), transport, waste, and residential projects, as well as compensation, land valuation and rating. He acts for developers, individuals, central government and local authorities. He frequently appears in courts and tribunals at all levels up to the Supreme Court, as well as at planning inquiries and examinations. He is a member of the Attorney General's A Panel of Counsel, in which capacity he acts for the Government in significant planning and public law cases, and he is an editor of the Encyclopaedia of Compulsory Purchase and Compensation and Ryde on Rating. He has been shortlisted for Planning and Land Use Junior of the Year by the Legal 500 Bar Awards 2024 and is consistently ranked as a top-rated junior in Planning Magazine’s survey.

Hugh has extensive experience of acting for promoters and interested parties in respect of major infrastructure projects, both as sole counsel and as part of a counsel team. These include projects under the Planning Act 2008 as well as other regimes. He has particular experience of energy, aviation, rail, road and waste projects.
Major infrastructure clients include: Heathrow Airport; EDF Energy; Sottish Power Renewables; Network Rail; Aquind Ltd; London City Airport; Highways England; Thames Water; and Horizon Nuclear Power.

Hugh has a significant rating practice and is described by the Legal 500 as "a real technical expert" in the field (2021). Apr' 25High Court Clarifies Scope of Use Class E
On 10 April 2025, Mrs. Justice Lang dismissed a claim for planning statutory review brought by West Suffolk Council against a decision of a planning inspector to grant a s.191 certificate of lawful existing use which confirmed that the use made by the Animal Health Trust for research and development and for veterinary clinical services of its former campus in Suffolk fell within Use Class E.

The Court of Appeal has handed down judgment in Mead Realisations Ltd v Secretary of State for Housing, Communities and Local Government [2025] EWCA Civ 32, providing guidance on flood risk policy and guidance in the National Planning Policy Framework (“NPPF”) and Planning Practice Guidance (“PPG”), and the role and relationship of the NPPF and PPG more generally.

Dec' 24£332m Highway Infrastructure Scheme In Oxfordshire Granted Planning Permission By The Secretary of State
The Secretary of State for Housing, Communities and Local Government has granted planning permission for the HIF1 highway infrastructure scheme, after a conjoined public inquiry into the called-in planning application and the related Compulsory Purchase Order and Highways Act orders, which sat for 21 days between February and May 2024.
