Supreme Court to Consider Final Injunctions Against Newcomers

On Wednesday 8 and Thursday 9 February, the Supreme Court is to consider whether a final injunction can prevent persons, who are unknown and unidentified as at the date of the injunction order, from occupying or trespassing on land in Wolverhampton City Council and others (Respondents) v London Gypsies and Travellers and others (Appellants).

Although the genesis of the case lies in injunctions seeking to prevent gypsy and traveller encampments, the issue on appeal will have application to other injunctive relief against persons unknown – in particular in the context of protest injunctions. It is for that reason that the Supreme Court has granted permission to intervene to Friends of the Earth, Liberty, High Speed Two (HS2) Limited, and the Secretary of State for Transport.
