Proceedings closed last week in the final chapter of the claim against the Environment Agency for damage caused to the historic Grade II listed Tudor King’s Lodging on the banks of the River Stour in Kent.  

The claimant landowners are seeking damages under a private contract and compensation under the Water Resources Act 1991 to rectify damage caused by faulty flood defence works installed by the EA, and to cover the cost of rectifying the leaking flood defences.  The case is set to become the leading case on flood liability of the EA under the WRA 1991. Judgment is awaited.
