Compensation for Compulsory Purchase in the Cayman Islands

Guy Roots QC

In a decision given on 24th November 2009 in Concept Ltd v The National Roads Authority, the Grand Court of the Cayman Islands has given the first authoritative interpretation of the local law of compensation for the compulsory purchase of land, aligning it closely with established English law. Issues addressed included the basis of assessing the value of the land taken, the meaning of ‘market value' and the scope of severance compensation.

Guy Roots QC appeared for the acquiring authority, leading and instructed by Ms Vicki Ellis, Acting Solicitor General.
