SoS Makes the Rixton and Warburton Bridge Order

The Secretary of State for Transport has made the Manchester Ship Canal Company (Rixton and Warburton) Bridge Order 2023, a Transport & Works Act Order that will provide for a sustainable future for the Rixton and Warburton Bridge, a C19 iron toll bridge crossing the Manchester Ship Canal.

The Manchester Ship Canal Company Limited ('MSCC') sought an Order that would enable them to raise tolls on the Bridge from 12p to £1 and to index link those tolls going forward, for the purposes of refurbishing the Bridge and introducing free-flow tolling technology. The changes were locally controversial, with more than 300 objections to the Order, and five MPs attending the Inquiry to support those objections, and with arguments being raised as to MSCC's entitlement to charge tolls as a matter of law. Following an inquiry in November 2022, the SoS has however agreed with his Inspector's recommendation to make the Order, accepting MSCC's arguments in respect of the law and finding a "compelling case" for the changes sought.
